These terms were prepared for AVMDEVS LLC, the company that runs Trendetna, and they describe how the site actually works today; a lawyer should review them before they are relied on.
By using trendetna.com, or booking through it, you agree to what follows.
What Trendetna is
Trendetna is a place to find experiences and book them. The site is operated by AVMDEVS LLC, of Sherman Oaks, California, United States.
What Trendetna is not
We do not run any of the experiences. Every tour, transfer, activity and venue on this site belongs to an independent operator with their own staff, equipment, licences and insurance. They decide what is available, at what price and on what terms; they run the day; and they are responsible for it. When you book, you are buying that operator's experience through us.
We also do not write the listings. Availability, times, prices and cancellation terms come from the operator's own reservation system, which is why some pages carry less detail than we would like. We would rather show you what the operator published than fill the gap with something we invented.
Your account
You need an account to book, to save an experience, to plan a trip or to post in the community. Use a real email address, keep your password to yourself, and tell us if you think somebody else has been in your account. You are responsible for what happens under it.
You can see every device signed in on your account page and end any of them, and you can delete the account entirely. To make a booking you need to be old enough to enter into a contract where you live.
Booking and payment
A booking goes through three steps, in this order:
- We ask the operator's system to hold your places. The hold is short and expires on its own if you do not finish.
- You pay. Payments are handled by Stripe; your card details go to Stripe and never reach us.
- Only once the money has arrived do we confirm the booking with the operator, and the ticket or reference their system issues comes back to you by email.
If the payment fails, or you abandon the checkout, the hold is released and you are not charged. If the payment succeeds but the operator's system does not accept the confirmation, we do not pretend otherwise: the booking shows as awaiting confirmation and somebody here picks it up.
The amount is taken when you book. On some bookings it is authorised on your card first and taken later, nearer the departure; either way it is the amount you were shown at checkout.
If the site is running in test mode, the checkout says so on the page, no real money moves and no operator is committed.
Prices and currency
The price of an experience is the operator's, quoted by their system for the party and time slot you picked. We do not mark it up.
Anything we add is a separate line at checkout, shown before you enter a card:
- A Trendetna booking fee, where one applies.
- A currency conversion fee, only when you pay in a currency other than the operator's, covering what our payment processor charges us for the conversion.
Both figures, as they are set right now, are published on our how it works page, which reads them from the running system rather than from a marketing document. No charge appears after you have committed.
Prices shown elsewhere on the site in a currency other than the operator's are converted at a mid-market rate and marked as approximate. They are a guide. What you actually pay is calculated on our server from a fresh quote from the operator, and the rate used is recorded on your receipt.
Cancellations and refunds
The operator's own policy decides whether a cancelled booking is refunded. What we do about it, and what happens when an operator cancels, is set out on the cancellations and refunds page, which forms part of these terms.
The community feed
Anyone with an account can post questions, tips and reviews, reply to other people, and add photographs. Reviews are written by members, not by us and not by anybody paid to write them.
Post honestly and from your own experience. Do not post other people's personal information, anything unlawful, spam or advertising, or content you have no right to share.
What we do about it:
- A filter runs on everything posted. A short list of slurs and phrases aimed at hurting somebody is refused outright. Ordinary profanity, and words that are a slur in one context and innocent in another, are published and queued for a person to read, because a word list cannot tell those apart and should not pretend to.
- Any reader can report a post, once per post, and every report reaches the same queue.
- We can hide or remove a post, and we can close an account that keeps at it. A removed post is off the site; the row is kept so reports about it can still be resolved.
- You can block another member. It needs no reason and no approval, and the person blocked is not told.
- You can delete your own posts at any time.
Posts written by Etna, our assistant, are labelled as such.
What you post stays yours. By posting it here you give us permission to show it on the site.
Etna and trip planning
Etna answers from our own catalogue and may only recommend listings that exist in it. It cannot invent a venue, a price or a rating, and it cannot link you off the site. It is still a language model: it can be wrong, out of date or confidently unhelpful. Check anything that matters against the listing itself, and anything critical with the operator, before you travel.
Operators listing with us
Companies apply to list through our supplier page, and every application is reviewed before anything appears on the site. Listing with us does not make an operator our employee, agent or partner.
Where our responsibility ends
We are responsible for running this site properly: charging you the amount shown, passing your booking to the operator, telling you the truth about what happened to it, and handling your data as our privacy policy describes.
The operator is responsible for the experience: turning up, running it safely and lawfully, holding the right licences and insurance, and honouring their own terms. If something goes wrong on the day it is between you and them, though we will help where we can, and if an operator failed to deliver what you booked we would far rather hear about it than not.
We do not promise that the site is always available or always free of errors, and we are not liable for what an operator does or fails to do. To the fullest extent the law allows, anything we are liable for in connection with a booking is limited to the amount you paid for that booking through us. Nothing here limits liability the law does not allow us to limit, including for death or personal injury caused by our own negligence, or for fraud.
Changes
We can change these terms. The current version is always on this page, with the date it last changed at the top. A booking is governed by the terms in force when it was made.
Governing law
These terms are governed by the laws of the State of California, in the United States, and the courts of California have jurisdiction over any dispute arising out of them.
